These Terms of Service ("Terms") govern your use of the RealTalk mobile application and any related services (the "Services") operated by RealTalk Labs ("we," "us," or "our"). By creating an account, downloading the app, or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Services.
You must be at least 13 years old to use the Services. If you are between 13 and 18, you must have permission from a parent or legal guardian. By using the Services you represent that you meet these age requirements.
The Services are not directed at children under 13 and we do not knowingly collect personal information from anyone under 13.
RealTalk is an AI-assisted communication tool that helps users craft replies to messages. You paste a message you have received, choose a tone, and the Services generate three suggested replies using a large language model. You may refine the suggestions and copy them for use in your own communications.
The Services are intended for personal, non-commercial use. AI-generated text is provided as suggestions only — you remain solely responsible for any communication you send to a third party.
To use the Services you must create an account using a valid email address. You are responsible for safeguarding your password and for any activity that occurs under your account. You agree to provide accurate, current, and complete information when registering, and to update it as needed.
You may delete your account at any time from Settings → Delete account, which permanently removes your account, reply history, and any associated data from our systems.
The Services include both a free tier and an optional paid Premium subscription. The free tier provides three lifetime AI reply generations. Premium provides unlimited generations, additional tones, and other features described in the app at the time of purchase.
Premium subscriptions are sold and billed through the Apple App Store, not by us directly. By subscribing, you agree to Apple's terms in addition to these Terms. Pricing is displayed in the app and may vary by region or change over time.
Free Trial: If a free trial is offered (currently 7 days on the Yearly plan), you will not be charged during the trial. Your subscription begins at the end of the trial unless you cancel beforehand.
Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the current period ends. Renewal charges are made to your Apple ID at the rate then in effect.
To cancel a subscription:
Cancellation takes effect at the end of the current billing period. You retain Premium access until that date.
All payments and refunds are handled by Apple under Apple's refund policy. To request a refund, visit reportaproblem.apple.com and select your RealTalk purchase. We cannot issue refunds directly. If Apple's process does not resolve your concern, contact us at support@getrealtalk.ai and we will do our best to assist.
You agree not to use the Services to:
We reserve the right to suspend or terminate any account that violates these rules.
AI-generated suggestions may be inaccurate, inappropriate for your specific situation, or reflect biases present in the underlying training data. You are responsible for reviewing and editing any suggested reply before sending it to a third party.
The Services are not a substitute for professional advice. Do not rely on AI-generated suggestions for legal, medical, financial, mental-health, or safety-critical decisions.
You retain ownership of the messages you paste into the app and of the suggested replies the AI generates for you. We do not claim ownership of your inputs or outputs.
The Services, including the software, design, branding, and content provided by us, are owned by RealTalk Labs and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes in accordance with these Terms.
You may not copy, modify, distribute, sell, or lease any part of the Services without our written permission.
The Services rely on third-party providers including:
Use of these providers is subject to their own terms and privacy policies. We are not responsible for third-party services or for content delivered by them.
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Services you consent to the practices described in the Privacy Policy.
You may stop using the Services and delete your account at any time. We may suspend or terminate your access immediately, without prior notice, if you violate these Terms or if continued provision of the Services to you creates legal or operational risk for us.
On termination, your rights to use the Services cease. Provisions that by their nature should survive termination (including ownership, limitations of liability, dispute resolution, and indemnification) will continue to apply.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE, COMPLETE, OR APPROPRIATE FOR YOUR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US (THROUGH APPLE) IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. FOR FREE-TIER USERS, THIS AMOUNT IS ZERO.
IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you in full. Nothing in these Terms limits liability for gross negligence, wilful misconduct, fraud, or for any liability that cannot be limited under applicable law (including personal injury or death).
You agree to defend, indemnify, and hold harmless RealTalk Labs and its officers, directors, employees, and contractors from any claims, damages, costs, or expenses (including reasonable legal fees) arising out of: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to the Services or generate using them.
Informal resolution first. Before filing any formal claim, you agree to contact us at support@getrealtalk.ai and attempt to resolve the dispute informally. Both parties will work in good faith for at least 30 days to reach a resolution.
Binding arbitration. If informal resolution fails, any remaining dispute will be resolved by binding arbitration administered under the rules of a recognized arbitration body in your province of residence (for Canadian users) or the appropriate forum in the user's country. The arbitrator's decision will be final.
Class action waiver. Disputes will be resolved on an individual basis. You agree not to bring or participate in any class, collective, or representative action.
Carve-outs. Either party may seek injunctive relief in court for intellectual property infringement. Users in the European Union, the United Kingdom, Quebec, and other jurisdictions where mandatory arbitration is prohibited for consumer contracts retain their right to bring claims in their local courts.
These Terms are governed by the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein, without regard to conflict-of-law principles, except where superseded by mandatory local consumer protection laws applicable to you.
We may update these Terms from time to time. If we make a material change, we will notify registered users by email at least 30 days before the change takes effect. Non-material changes (such as typo fixes or clarifications) take effect immediately, with the "Last updated" date at the top of this document revised accordingly.
Continued use of the Services after the effective date of an updated Terms constitutes acceptance of the changes. If you do not agree to a change, you must stop using the Services and may delete your account.
